The Thomas More Chambers Employment Law Team advises and represents clients in all areas of employment law.
The Employment Law Team regularly appear in the Employment Tribunals and civil courts representing employers, employees and former employees in relation to all aspects of employment litigation. The Team advises on and presents and defends claims relating to unfair and wrongful dismissal, breach of contract, unlawful deduction of wages (including holiday pay claims), all types of prohibited discrimination, harassment, victimisation and public interest disclosure/whistleblowing.
Members of the Employment Law Team also regularly draft policies for employers including disciplinary and grievance procedures, equality and diversity codes of conduct, health and safety policies and home working procedures.
The Employment Law Team advise and represent former employers, departing employees and new employers in relation to the enforcement of, or defence against, post termination restrictive covenants (including anti-competition clauses), breach of directors’ duties and misuse/misappropriation of confidential information. Members of the Employment Law Team regularly appear in the High Court in relation to injunctive proceedings to enforce such contractual provisions and rights or to challenge their enforceability. The Employment Law Team also has experience in representing parties in final hearings where these contractual rights and duties are in issue, often in the context of a speedy trial.
Members of the Employment Law act for both regulators and registrants in a variety of Fitness Pracise proceedings. Members are regularly instructed to appear before healthcare tribunals, including the General Medical Council (GMC), the Health & Care Professions Council (HCPC), and the Nursing and Midwifery Council (NMC). Members are also instructed to advise and and appear before the Solicitors Disciplinary Tribunal (SDT). Members are also instructed to appear on behalf of Social Work England (SWE) and the Teaching Regulatory Agency (TRA). Members are also instructed to appear as Special Counsel in several of these regulatory proceedings.
The Employment Law Team also has expertise in providing advice for regulators, including the drafting of Codes of Conduct, Policies and Disciplinary Regulations. One member of the Employment Law Team is a legally qualified chair who sits in both healthcare and social work proceedings.
Members of the Employment Law Team are experienced in achieving optimal outcomes in employment disputes through settlement, be it my means of arbitration, mediation (including Judicial Mediation) or general without prejudice communications. The Employment Law Team at Thomas More Chambers has the benefit of the use of a suite of mediation rooms and video conferencing facilities at 7 Lincoln’s Inn Fields. Members of the Team also regularly negotiate and advise both employers and employees in the context of Settlement Agreements.
